If any provision is found unlawful, void or unenforceable, it will be severed and the remaining provisions will stay in force.

No waiver of any term is a further or continuing waiver of that or any other term, and our failure to enforce a right is not a waiver of it.

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.

FX Recap is not liable for any failure or delay caused by circumstances beyond its reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, flood, accidents, network failures, strikes, or shortages of transport, facilities, fuel, energy, labour or materials.
